OUTDOOR SEATING POLICY

I. Placement

  • Sidewalks must maintain a clearance of six (6) feet for pedestrian traffic in all avenues.
  • Store entrances may not be blocked, and any seating must be at least three (3) feet away from the door(s) on either side.
  • Exterior sidewalks can be considered as part of emergency exit from any store, and may be subject to the Fire Marshall's approval for placement of seating.
  • Tables must be placed on the sidewalks, and no landscaped areas may be used.

II. Tables

  • Table dimensions shall not exceed three (3) feet in circumference or width.
  • Table composition must be approved by the Landlord prior to installation. The preference is for metal tables.
  • Tables may not exceed four (4) feet in height.
  • Each table that is not placed under a canopy must be covered by an umbrella. These umbrellas shall be of the “café” variety. Color and any logo must be approved by the landlord.

III. Chairs

  • Chairs and the composition material must be approved by the Landlord prior to installation. The preference is for metal chairs.
  • Chairs must be kept neatly by tables. No chair may obstruct the travel path. Store staff must maintain the orderliness of the seating.

IV. Maintenance

  • Trash must be emptied from sidewalk containers or any receptacle placed by the Tenant, not less than twice daily.
  • Chairs and tables must be cleaned daily.
  • The Tenant is responsible for clean up of any spills on the sidewalk, including power washing as needed.

All proposed outdoor seating must be submitted to A.J. Dwoskin & Associates for review and approval prior to its fabrication and/or placement. A.J. Dwoskin will not be responsible for any expenses incurred by tenant for having any outdoor tables/chairs fabricated and/or delivered prior to an approval and tenant shall remove any unapproved outdoor seating immediately at landlord's request.

All submittals must include the following information:

  1. Full specifications for tables and chairs (i.e. materials, dimensions, colors, etc.)
  2. Full specifications for umbrellas if applicable (i.e. materials, dimensions, colors, text content, etc.)
  3. Sketch/rendering of area indicating proposed location of tables and chairs placement.
  4. Photo of tables, chairs, & umbrellas.
  5. Any approval granted by A.J. Dwoskin & Associates for outdoor seating is contingent on tenant obtaining any and all permits/approvals from local jurisdiction. Copies of all required permits from the local county. If no permits are required, you must submit a letter stating that no permits are required.

Return to Property Management.
